ACCESSING THE SITE
Access to the Site is permitted on a temporary basis and SRI reserves the right to withdraw or amend the service it provides on the Site without notice. SRI will not be liable if for any reason the Site is unavailable at any time or for any period. From time to time, SRI may restrict access to some parts of the Site or the entire Site to registered users.  If you choose or you are provided with a user identification code password or any other piece of information as part of SRI’s security procedures, you must treat such information as confidential and you must not disclose it to any third party. SRI has the right to disable any user identification code or password whether chosen by you or allocated by SRI at any time if in its opinion you have failed to comply with any of the provisions of these Terms of Use.

USE OF THE SITE
When using the Site, you must comply with the provisions of the Acceptable Use Policy.  You are responsible for making all arrangements necessary for you to have access to our Site. You are also responsible for ensuring that all persons who access our Site through your internet connection are aware of these terms, and that they comply with them.  In no event will SRI be liable for any damages including without limitation direct, indirect or consequential damages or any damages whatsoever arising out of or in connection with the use of or loss of use of any part of or any material on the Site and regional urls including downloads whether an action based on contract tort or any other basis.

INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights in the Site and in the content published on it are owned by or licensed to SRI or otherwise used by or licensed to SRI as permitted by applicable law. Those works are protected by copyright laws, other intellectual property laws, and treaties around the world. All such rights are reserved.  You may not change or modify any material on this Site whether in hard copy or electronic format. You may not link frame or deep-link the material on this Site onto any other website without the express permission of SRI. No material on this Site may be used or distributed for commercial exploitation. Material on this Site may be used for personal and/or non-commercial purposes and in support of trade union/seafarers’ activities provided SRI/this Site is acknowledged as the source of the material and SRI is acknowledged as the author. IMPORTANT. This permission DOES NOT APPLY to material supplied by third parties. For permitted use of third party material, apply to the relevant owner of the material. If you print off, copy or download any part of our site in breach of these Terms of Use, without prejudice to any of our other rights and remedies, your right to use our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Information on the Site is not intended to amount to advice and is provided without any guarantees, conditions or warranties of any kind, either express or implied. To the extent permitted by law, SRI, its officers, employees and representatives hereby exclude responsibility and liability (express or implied, contractual, tortious or otherwise) arising from any reliance on material displayed or contributed to the Site including due to the quality, accuracy, completeness, correctness or timeliness of such information. Except as otherwise stated, any listing on the Site, be it actual text or hyperlink, is not necessarily meant to imply nor should the same be construed as an official endorsement on the part of SRI.

Links to external websites are provided for your convenience only. SRI makes no representations whatsoever about any other website which you may access through this Site. Further, SRI accepts no responsibility or liability for either the content or the upkeep of any linked third party website, nor the use of personal data by such third party. A link to a non-SRI website does not necessarily mean that SRI endorses the content or the use of such websites. Although all external links may be checked from time to time, SRI cannot be held responsible for the validity of any of the links and it is your responsibility to ensure that whatever you select for your use is free of such items as viruses, worms and other items of a destructive nature.

INTERRUPTION TO SERVICE
SRI makes every effort to ensure that the quality of the Site remains high. However the internet is not an inherently stable medium and information sent via the Site will pass over public telecommunications networks. In addition, from time to time, SRI may restrict access to some parts of the Site or the entire Site to perform necessary maintenance. SRI does not warrant that the functions contained in the material contained in the Site will be secure, uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the materials. As a result, SRI does not accept any ongoing obligation, liability or responsibility in respect of the same.

SUBMISSION OF CONTENT
If you submit any material to the Site including without limitation any text, graphics, video or audio (“Content”), or make contact with other users of the Site, you must comply with our Acceptable Use Policy. You warrant that any Content does comply with those standards, and you indemnify us for any breach of that warranty. SRI reserves the right to remove any Content if in its opinion such material does not comply with the Content standards set out in our Acceptable Use Policy. Any Content you submit to the Site will be considered non-confidential save that if Content is submitted to a password-protected area of this Site, SRI will endeavour to keep the Content confidential to the extent it is able. Any Content you submit to the Site will be considered non-proprietary and by such submission, you grant SRI all intellectual property rights with respect to the Content save that if SRI publishes the Content, it will acknowledge the author thereof. If you do not wish to grant such rights to SRI, you must not submit your Content to the Site.

PRIVACY
SRI processes information about you in accordance with the Privacy Policy. By using the Site, you consent to such processing and you warrant that all data provided by you is accurate.

OUR LIABILITY
The material displayed on our Site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

  • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

You agree on demand to indemnify, defend and hold harmless SRI from and against any claims, damages, losses, liabilities, and all costs and expenses of defence arising out of or in relation to: your breach of these Terms of Use; or any claim that is based on your use of the Site, your submission or dissemination of any of the information in the Site or content in the Site. You will cooperate as fully and as reasonably required in SRI’s defence of any claim. SRI reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and you will not in any event settle any matter without the written consent of SRI.

LAW AND JURISDICTION
These Terms of Use are governed by English law. The English courts will have exclusive jurisdiction over any claim or dispute arising out of or in connection with the use of the Site. You are solely responsible for insuring compliance with your local laws while using the Site and the materials contained in the Site.

VARIATIONS
SRI reserves the right to amend these Terms of Use at any time by posting changes online. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. You agree to be bound by such amendments from the date on which they are posted on the Site. If you cannot accept such amendments, you may notify SRI and cease using the Site. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on the Site.
